Offers concerned – Applicable from 1 January 2021

Decree No. 2020-1585 of December 14, 2020 relating to mandatory information for any furnished tourist rental offer specifies that from January 1, 2021:

  • Any offer to rent a furnished tourist accommodation from a professional must bear the mention "professional advertisement"
  • Any rental offer for furnished tourist accommodation that does not come from a professional must bear the words "announcement from a private individual".

These mentions must clearly appear on the publication of your offer on all the distribution platforms of your accommodation.

Definition of the “Private” or “Professional” status of the lessor:

You are concerned if:

  • You are the owner or manager of a furnished accommodation (villa, apartment, furnished studio), classified or not, labeled or not.
  • You propose the reservation of accommodation on the Internet

Your status is said to be a "Professional" under two cumulative conditions:

  • The annual revenue from this rental activity exceeds €23.000
  • The receipts exceed the income of your fiscal household subject to tax (wages and salaries, other industrial and commercial profits, etc.)

You must mention "professional announcement".

Otherwise, your status is said to be "Individual", you must mention "announcement of an individual".

The sanctions

The tourism code does not envisage any specific sanction. It is likely that the absence of the mention will be considered as a breach of the obligation of information weighing on the tourist. If this causes him harm, this could be reproached or this could be subject to a sanction from the Directorate for the Protection of the Population (DPP) in the event of an inspection.
